Famous TikTok lawyer takes on Last Generation after recent protest in Warsaw

On Wednesday, 28 August, activists from the Last Generation group made headlines once again, this time by splashing orange paint over the Złote Tarasy shopping centre. Their action aimed to highlight the urgency of their demands and the looming threat of the climate crisis. Lawyer Marcin Kruszewski criticised the incident.

Last Generation is a climate activist organisation that initially operated primarily in Italy, Germany, and Austria. Today, its presence has expanded across most European countries. On Wednesday, 28 August, two Polish members of the group splashed orange paint on the Złote Tarasy shopping mall, once again emphasising that people living today are part of the last generation and urgent action is needed to combat the effects of global warming.

Marcin Kruszewski, known on social media as Marcin's Law (Polish: Prawo Marcina), is a legal influencer who initially gained popularity among younger audiences by explaining students' rights and the legal limitations on teachers' actions. He has since broadened his commentary to cover various aspects of social life. In this instance, he shared his views on the recent actions of the Last Generation activists.

Marcin's Law vs Last Generation

The actions organised by the Last Generation have sparked polarising reactions. While many understand the motivations behind their tactics—such as blocking roads or splashing paint on buildings and artworks—as a desperate attempt to draw attention to the pressing issue of the climate crisis, others are simply frustrated. Commuters, for example, often find themselves unable to get to work due to activists sitting in the street, refusing to move. Lawyer and social media influencer Marcin Kruszewski recently weighed in on the debate.

"What do you think environmental protection is about? I thought it involved waste collection, avoiding littering, sorting rubbish, or even discussing how to quickly build a cleaner nuclear power plant in Poland instead of relying on coal. But according to the Last Generation activists, it seems to be about littering," Kruszewski remarked on social media.

"These activists went to the Złote Tarasy shopping centre in Warsaw and splashed paint, which will only create more work for cleaners. The owner will now have to spend money and use water to clean it up, making the situation both more expensive and less ecological. If they doubt whether this constitutes littering, the police or the court handling their case certainly won’t," he continued.

Kruszewski emphasised that there is no doubt the activists broke the law, as littering in a public place is a legal offence. He also pointed out that their actions could be considered disorderly conduct. The lawyer expressed scepticism about the activists' intentions, arguing that their actions contradict their stated environmental concerns.
