LGBTQ+ activist has filed a complaint against Poland with the EC. What does he want to achieve?

The Basta Foundation led by Bart Staszewski has filed an official complaint against Poland with the European Commission. It wants to force the Polish National Broadcasting Council (KRRiT) to comply with anti-discrimination legislation.

On 12 July, Bart Staszewski, on behalf of the Basta Foundation, filed an official complaint against Poland with a representative of the European Commission.

KRRiT does not react to Basta Foundation's complaints

The complaint concerns the lack of reaction of KRRiT to reports that TVP and Radio Maryja are violating the Broadcasting Act. The provisions of the Act, amended in 2019, include, among other things, provisions prohibiting the publication of content that discriminates and incites hatred on the basis of sexual orientation.

The complaint to the European Commission is the result of our helplessness, it is a cry for justice. Being Polish it is hard for me to make such a complaint, but we have exhausted all other possibilities.

The National Broadcasting Council did not react to the complaints of Staszewski's foundation. On 29 May, the Voivodship Administrative Court in Warsaw confirmed that the KRRiT had violated the law by ignoring the Foundation's applications. It ordered the Council to consider the applications submitted by the activists. However, as Basta reports, no penalties were imposed on broadcasters publishing discriminatory content.

As a result, Basta has submitted an official complaint against Poland for failure to comply with anti-discrimination law. The European Commission has 14 days to respond.
